1. Peaceful enjoyment:
Lessor covenants that on paying rent and in the covenants contained herein, the Lessee shall peacefully hold and enjoy the premises along with other house or room Lessees or roommates for the agreed term. This entails:
a) Treat everyone with respect and behave lawfully, to all persons, possessions, to shared resources and spaces as well as the premises. b) No excessive noise. No noise after 7 pm on Weekdays, No noise after 10 pm on weekends. c) Visitors should leave the premises by 11pm on any given day unless there is a group social event being held on the premises with the consent and or due notice by all Lessees. On days of such events, visitors must leave the premises by 10 pm.
d) Visitors may not overnight on the premises under any circumstances. e) No weapons are allowed on the premises. f) No smoking within any of the buildings including rooms and indoor shared areas. Smoking to be conducted strictly in dedicated outdoor areas. g) No glass around pool area. Please make use of plastic cups provided in the entertainment are. h) No household furniture, resources or utensils, moveable or unmoveable objects may be removed from the premises.
2. Security deposit:
Prior to the commencement of the term, the Lessee will deposit with the Lessor the sum of N$ 500 to be held in an account as security for the faithful performance by the Lessee of the terms thereof. Lessor may use the security deposit to pay amounts owed by Lessee including damages. The amounts will be payable against the exchange rate on the day which the agreement commences. The Lessee will be liable to pay the full amount of damages incurred exceeding the amount of the security deposit.
If no damages are found upon departure of the Lessee, the amount will be returned to him/her in ful. All damages & breakages to any furniture, utensils, appliances or property must immediately be reported to the operations Manager. 3. 3. Cleaning & Upkeep of the premises:
a) Cleaning & Upkeep of the premises: Cleaning is included as a service twice a week. Your room will only be cleaned if you want it to be cleaned and indicate it as such by leaving your room unlocked. Please ensure that your valuables are packed away in your cupboard or locker. Bedding will be washed once every 2 or 3 weeks. If you want your bedding washed, please remove all sheets and leave it on the bed.
b) Day to day upkeep: The LESSEE shall keep the premises neat and tidy cleaning up after themselves. The LESSEE shall maintain the premises in a good, clean condition, and use the premises only in a careful and lawful manner. The LESSEE shall leave the premises in well maintained condition at the expiration of the rental agreement, defined by the LESSOR as being habitable for the future tenants.
c) Weekly upkeep: The LESSOR shall ensure top to bottom cleaning at the expense of the LESSOR twice a week.
d) Upkeep of personal items: The LESSEE shall be responsible for the upkeep of their personal items such as laundry and may use the facilities available to them on the premises at no extra cost. The Lessee may also request RedApron services to complete such tasks.
e) Repairs and maintenance: The Lessor shall be responsible for all repairs and maintenance of the premises not due to the LESSEES misuse or neglect. LESSEES shall pay for maintenance and repairs should the premises be left in a lesser condition. The LESSEES agree that the LESSOR shall deduct costs of said services from the security deposit prior to refund if LESSEES cause damage to the premises or it's furnishings. The LESSEE shall pay for any damage done to the premises over and above normal wear and tear.
4. Inspection of premises:
The LESSOR has the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Should the LESSEE violate any of the terms of this agreement, the rental period shall be terminated immediately.
5. Vacation of premises:
The LESSEE waives all rights to process if they fail to vacate the premises upon termination of the rental period. The LESSEE shall vacate the premises at the expiration time and date of this agreement.
6. Emergency services:
Emergency medical and police service can be called bythe Lessee using the guide provided. The Operations Manager.
7. Safety & Security:
a) Access to premises: The LESSOR ensures safe and secure access to the premises by LESSEE.
b) Contract terms: The LESSOR ensures further safety via the terms within this contract. Pertaining to visitors, LESSOR is responsible for own personal items.
c) From points 3C above: Visitors should leave the premises by 7pm on any given day unless there is a group social event being held on the premises with the consent and or due notice by all Lessees. On days of such events, visitors must leave the premises by 10 pm.
d) From points 3d above: Visitors may not overnight on the premises under any circumstances.
8. Personal Items:
The LESSOR will not be held liable for damaged and or missing items. If something goes missing.
